Information about the Controller

Thanks for visiting H2-Fifty.com and/or doing business with us. We welcome your interest in this website, our products and services and/or doing business with us. The company responsible for this is H2-Fifty B.V. (“H2-Fifty”), registered in the Commercial Register of the Dutch Chamber of Commerce under number 87949342, having its office at Van Asch van Wijckstraat 53, (3811 LP) Amersfoort, The Netherlands. Unless otherwise stated or the context otherwise requires, the term “H2-Fifty” and terms such as “we”, “us” and “our” are used on this website for convenience to refer to H2-Fifty B.V.

H2-Fifty is a joint venture of BP Europa SE and H2-Fifty Sub B.V. (“Shareholders”). The Shareholders and each of their group companies are separate legal entities (together referred to as “Shareholders and Group companies”). H2-Fifty B.V. is the (main) controller of your personal data. In case Shareholders and/or Group companies would process your personal data in relation with the business of H2-Fifty, these companies will observe this Privacy Statement. H2-Fifty B.V. remains your main point of contact relating to processing activities.

We take your privacy seriously and want you to understand our practices with respect to the handling of your personal data. This Privacy Statement explains how we do this. We also refer to our Cookie Statement (as further referred to below).

Collection & use of the Personal Information

As part of or in relation with your visit to our website or our premises/site and/or the products and/or services we provide or purchase, H2-Fifty may process the following personal information about you:

  • Basic personal details such as your name and job title;

  • Your contact details, such as (business) telephone number and postal or email address;

  • Financial data such as payment related information or bank account details (in case this would include personal data);

  • Your preferences or interests, for example in regard of the use of our website or receiving any newsletter;

  • (Other) data collected when you visit our website, for example through cookies. This may include (for example) your IP address, browser type and language, approximate location and the date and time of your visit. We use the information we collect from you in order to:

a) enter in to and/or perform the contract we have with you/your company for the provision of products and/or services;

b) communicate with you in regard of any requests about our or your products/services, business activities or other query;

d) contact you with information (also including marketing communications) on additional products and/or services and/or business activities which may be of interest to you (for which we will ask consent if legally required); or

e) improve the quality, content and relevance of our communications by following your interactions with that communication, such as whether you receive, open or click on a link within an email communication or use our website;

f) to optimize and secure our website.

Legal basis/legitimate reason for processing personal information

Your personal information will be used based on the performance of our contract with you, or if and to the extent you have actively consented to certain use, or if it is necessary for H2-Fifty to comply with its legal obligations. In case of consent, you can withdraw your consent/unsubscribe to our communication and/or modify your preferences at any time, by clicking on the link at the bottom of each communication or follow any other opt-out instructions contained in each subsequent communication, or by contacting us via contact@bp.nl.

We may also process your personal information for legitimate business reasons. This legitimate interest consists in contacting and informing you about our products and/or services (including marketing communications), keeping our information and communication secure and optimize our processes and communication, which we believe is strong enough to outweigh individuals’ right to privacy (notwithstanding our legal obligations regarding marketing communication).

How we obtain personal data

You may provide personal data to us when visiting our website, premises/site, (exploration of) doing business with us, subscribe to our newsletter or contacting us in any other way. Mainly, providing personal data to us is completely voluntary. However, in case you would not provide us personal data, we may not be able to provide certain services and/or contact you. In addition, we refer to the Cookie Statement regarding collection of personal data by using cookies on our website. Certain (tracking) cookies can be disabled through our cookie preference page.

Recipients and security of the Personal Information

We will use best efforts to take appropriate security measures to protect your personal data. Access to your personal data will be limited to the relevant employees of H2-Fifty and/or Shareholders and/or its Group companies responsible for public engagement and procurement and/or otherwise involved in our (processing) activities. We may also engage third parties in regard of our products/services and otherwise relating to our business, such as software providers and/or transport service providers, that may process your personal data. We will agree upon appropriate safeguards to protect your personal data. We reserve the right to disclose your personal information as required by law, or when disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order or request from a regulator/authority.

In principle, we only process your personal data within the European Economic Area (EEA). In case we would transfer personal data tot non-EEA countries, we will do so under the conditions set by applicable privacy law.

In the unlikely event that you find a security breach or suspect that the security of your personal data is in danger, please contact us immediately via contact@bp.nl.

Retention Period

We will only hold your information for as long as necessary to fulfil the purposes for which it was collected (or compatible purposes as legally allowed), or any longer as necessary to comply with our legal obligations (e.g. tax obligations) or to fulfill our legitimate interest that outweighs privacy interests. After this period, we will make it non-identifiable or delete it. In general, we will only keep record of your contact details relating to any question or complaint until we have answered your query or finally handled your request or complaint as mentioned below (except any longer retention period is reasonably necessary, for example for legal evidence objectives).

Individual's rights (e.g. access, rectification and erasure)

In case we process your personal data, you may ask us to provide you with access to and/or information about the personal data we process about you. You are also entitled to request for any incomplete or inaccurate personal data which relates to you to be corrected, to restrict the processing, or to erase your personal data if, for example, the processing is not (or no longer) compliant with applicable privacy legislation. Furthermore, in certain circumstances you are entitled to object to the processing of your personal data, for example in case you believe that the data concerned is not necessary for our legitimate business reasons. Besides, you may always withdraw your consent to the processing (if based on your consent) and you can request us to arrange a transfer of your personal data to another party.

Your exercise of these rights may be subject to certain (legal) exemptions. Therefore, we are not always obliged to comply with your requests. In case of any request for removal or withdrawal of consent, this will not affect former processing activities and it may not be reasonably possible to remove all copies of personal data from systems and back-up systems for technical reasons.

If you want to exercise any of these rights or in case you would have questions or complaints about the processing of your personal data, please get in touch with us via contact@bp.nl. We may ask you to explain your request in more detail and/or to further identify yourself. In principle, you will receive a response within one month after receipt of your request. In case you would not be satisfied with the way we have dealt with any request or complaint, you may also lodge a complaint with your national data protection supervisory authority (in the Netherlands: Autoriteit Persoonsgegevens).

We may update this Privacy Statement from time to time without notice and recommend that you revisit it on occasion to see the latest version. You can always find the latest version on our website. This Privacy Statement became effective on 31 October 2022 and was last reviewed on 30 October 2022.
